TSAOM is the first Saudi Company that offers a website and mobile app platforms with Multi-languages and a great user experience for sellers and buyers to exchange goods and services for free.

Our main goals:

1. Provide a healthy, clean, and a reliable pool of second-hand, homemade and new products for buyers.

2. Assist in easing and building sellers portfolio and reputation in the market while expanding its reach.

3. Connect millions of people in the Kingdom in one platform to buy and sell products and services.

The following terms and phrases are hereby assigned to them in this Privacy Policy:

Services means any goods, services, information, functionality, technologies or functions, and all relevant websites, applications and services provided by us to you.

Platform: refers to the sites, mobile apps, mobile websites or other online properties from which our services are provided.

The arrangement between you and TSAOM is set out in the Terms of use. It governs the use of the Services and Platforms we offer.

 These Terms of Use provide you with descriptions of the terms by which we intend to provide, approve and allow you to access and use the Platforms. Please print and refer to a copy of these Terms of Use when you use our sites and services. If you begin using the Platforms, you agree to be bound by these Terms of Use. You must immediately refrain from using the Websites and the Facilities if you do not consent to these Terms of Use. At any time, we can make adjustments and/or improvements and/or changes to the Terms of Use in part and/or in full. IF ANY Potential Improvements AND / OR UPDATES AND / OR MODIFICATIONS ARE Intolerable TO YOU, YOU SHOULD DISCONTINUE THE USE OF THE PLATFORMS AND SERVICES. YOUR CONTINUE USE OF THE PLATFORMS AND SERVICES WILL NOW OR FOLLOW THE POSTING OF ANY SUCHED CHANGES AND / OR UPDATES AND / OR MODIFICATIONS.

1. ACCEPTANCE OF THESE TERMS OF USE  

   1. Subject to these Terms of Use (referred to herein as the "Terms"), the Site and the Service are given to you. You accept that you have read, understood, and agree to be bound by these Terms and the Privacy Policy when accessing the Website or using the Service. The terms 'you' and 'your' shall mean any person who uses the Platform or the Service in any way whatsoever for the purposes of the Terms and wherever the meaning so requires, including, without limitation, persons browsing or/and searching the Platform and its content, posting comments, chatting or any content or reacting to any listing or content on the Platform.

   2. You consent to comply with these terms by visiting and/or using the Website and/or the Service. In addition, you agree to comply with any relevant posted guidelines for that Service while using a portion of the Service, which may alter and/or be revised from time to time at the sole discretion of TSAOM. These changes are effective as of the date they were reported on the website.

   3. From time to time, you are entirely responsible for revising these terms. If you disagree to, or become dissatisfied with TSAOM or the Service in any way with any term or condition of these Terms, any guidelines or any subsequent changes thereto, you must immediately discontinue the use of the Site and the Service, otherwise the express consent of these Terms shall be considered to constitute such continued use.

   4. TSAOM can provide a translation into other languages of the English version of the words. Any translation of the Words into other languages is for your convenience only and your relationship with TSAOM shall be superseded and regulated by the English edition, irrespective of any other translation that may be given therein. In addition, the English version of the Terms shall prevail if there are any inconsistencies between the English version of the Terms and any translation.

   5. These Terms may be updated by TSAOM at any time at its sole discretion. It is your responsibility to check the latest Terms and keep a copy of these Terms.

2. DESCRIPTION OF SERVICE AND CONTENT POLICY

1. TSAOM legal obligations and responsibilities are excluded or limited; -you accept risk, responsibilities and liability; and-any rights you have against TSAOM are restricted or excluded. The claims made in this section are your acknowledgments of fact. As you would not be able to refute the validity of the claims, you must read these statements carefully to ensure they are accurate. As a consequence of these statements, TSAOM and / or other people may have claims and other rights against you.

2. TSAOM is a platform that enables our users to offer, sell and purchase the goods and services listed on the Platform that comply with these Terms. While you might be able to use third-party vendors to make purchases and other transactions through the Platform, TSAOM is not involved in such transactions in any way, including but not limited to the payment of any sales or related taxes. As a result, and as discussed in more detail in these Words, you hereby accept and agree that TSAOM is not a party to such transactions, that TSAOM has no power over any aspect of such transactions, and that, to the degree permitted by law, that TSAOM is not responsible for any party to such transactions. TSAOM shall not include any warranty or guarantee and shall not be liable for any goods or services listed, sold or purchased and shall not be liable for any returns, refunds or disputes between Platform users. You are using the Service and the Network at your own risk and liability, as far as the law requires.
    

3. You agree that TSAOM is not liable for listings, advertising, user-generated material, directory details, business listings / information, user-to - user messages, including, without limitation, e-mails or chats or other means of electronic communication, whether through the Platform or some other third party platform (as specified below), or for offers, comments, user postings, data, photographs, pictures, vi You are responsible for and must assess, and bear all risks associated with, the use of any material, as far as the law allows. Under no circumstances would TSAOM be liable in any way for the Content or for any loss and/or harm of any sort sustained as a result of browsing, searching, using or reading any of the Content mentioned, e-mailed or otherwise made available via the Service. You need not depend on said Content. TSAOM is not obliged to pre-screen or authorize any Content, but TSAOM is entitled, in its sole and utter discretion, to deny, remove or transfer any Content that is or may be accessible through the Service in breach of these Terms and is brought to the attention of TSAOM or for any other reason or no reason whatsoever for such breach. In addition, the Platform and Content accessible via the Platform which include links to other websites of third parties ('Third Party Platforms') that are entirely unrelated to TSAOM. If you connect to third-party platforms, you can be subject to the terms and conditions and other policies of those third-party platforms. As far as the law permits, TSAOM makes no representation or assurance as to the quality or validity of the information found in all such Third Party Platforms, and as far as the law permits, your access to any other websites is entirely at your own risk and TSAOM disclaims all liability.

4. You are solely responsible for the Service and the effects of uploading, transmitting, linking or publishing your own content posted on, transmitted via, or connected from the Service. In particular, you are solely liable for any material that you upload, email or otherwise make available via the Service. You affirm, accept, reflect, warrant and covenant that in relation to certain content posted on, transmitted via, or connected from the Service by you:

1. You own or have and continue to have the requisite licenses, privileges, consents and permits to use any Content on the Service and Platform (including without limitation any patent, trademark, trade secret, copyright or other exclusive rights in and to any and all such Content) for any Content available on the Platform, and to allow TSAOM to use such Content in any way whatsoever

2. You have the written consent, release, and/or permission of each and every individual or business identifiable in the Content to use the name or likeness of each and every individual or business identifiable to allow the Content to be used and used in the manner envisaged by the Service, the Platform and these Terms. However, by uploading any Content on the Website, you hereby grant TSAOM an irrevocable, non-cancellable, permanent, worldwide, non-exclusive, royalty-free, sub-licensable, transferable license to use, reproduce, distribute, prepare derivative works of, view and execute the Content in connection with the Platform and perform the Content in connection with the Platform. TSAOM needs these rights in order to host and view your content. In addition, by uploading Content to any area of the Service, you accept and grant TSAOM all rights necessary to prevent or permit any subsequent aggregation, display, copying, replication, reproduction or exploitation by any party for any reason contrary to these Terms of Content on the Site or Website. These rights are perpetual and you cannot revoke them and they will apply and can be exercised worldwide. You also hereby grant a non-exclusive license to each user of the Platform to access your Content via the Platform (this license excludes cases of automated data collection / scraping and any other potential commercial use).

3. TSAOM does not support any material or any view, argument, suggestion or advice expressed therein, and TSAOM specifically disclaims any and all liability in relation to user content as far as the law permits. TSAOM does not enable infringing activities and infringing intellectual property rights on the Platform to be copyrighted and TSAOM can delete any infringing Content at its absolute discretion. TSAOM reserves the right, without prior notice, to delete any information. It is also possible for TSAOM to terminate user access to the Site. In addition, TSAOM reserves the right, at its absolute discretion, to determine if any material is acceptable and complies with these Terms.

1. The following activities are considered forbidden:

• Creating several accounts

• Selling any accounts

• Create any account with false or misleading details

• Posting duplicate content

• Deleting and reposting the same listing

• Posting content with misleading names, content, or photos

• Posting content with inappropriate images

• Posting content in incorrect categories

• Posting content with unrealistic prices

• Posting of content with links to other websites

• Uploading photos containing names, phone numbers or other terms

• Posting of phone numbers in listing titles

• Posting of content with options for prepayment or bank transfer

• Posting of generic content

• Posting of several products in a single post

6. Any public or private listing / post or message or comment containing one or more of the below prohibited content will be removed until TSAOM has defined and/or informed TSAOM in writing about it and TSAOM reserves the right to permanently remove the user account, blacklist the account and/or report the content and user information to Law Enforcement or the appropriate Authority:

• Alcoholic beverages, liquor, tobacco products, pharmaceutical products, psychotropic substances, medicines, intoxicants of any sort, medicinal products, palliative / curative substances, or liquid substances of any description.

• Alive, deceased and/or any or some portion of any human being kept or preserved by some means, whether artificial or natural, such as any blood, body fluids and/or parts of the body.

• Prostitution or any other service of that type intended to breach the provisions of the illegal act or the Improper representation of women, which in Arab society violate contemporary moral standards and dignity.

• Religious items, including books, objects, etc. or any details, an overview of any such product that is likely to affect any individual or group 's religious feelings

• Offensive content intended for sexual use (including "bondage" and "fetish" items) that displays sexual activity or depicts human genitals in a "reality-like" or consistent manner.

• " Antiquities "and" Art Treasures "are not permitted under any relevant legislation for sale or exchange.

• Information or items that are defamatory, libelous, hazardous or abusive in nature.

• Dishonest, misrepresenting facts as to the value and use of products or services.

• False, counterfeited and stolen goods or unauthorized illegal services (services for which you are not allowed or authorized to undertake or do not have the authority).

• Products, goods and services that infringe or threaten to transfer intellectual property or publicity rights or legal rights to any third party, and or purport to infringe the right to privacy of any individual.

• Electronically transmitting viruses of certain type or any computer program by any medium that enables the hacking of a computer system intended to harm or intercept any personal data from a computer or computer network.

• Dangerous pesticides and chemicals

• Fireworks, prohibited weapons and explosives, including any material that allows fireworks, explosive triggers and explosive devices to be made.

• Identification papers, personal financial records & personal details (in any form, including mailing lists)

• Lottery Tickets, Entries for Sweepstakes and Slot Machines

• Military or police badges, uniforms, coats of arms and or other military or police-related government emblems, insignia and/or products not allowed for sale or trading under any applicable law

• Weapons and related articles (e.g. firearms, pieces of firearms and magazines, ammunition, tear gas, stun guns or switchblade knives)

• Pyramid schemes' and 'Multilevel Marketing' and/or related scams listed for the sole purpose of defrauding users.

• Spam, offensive, replication, listing, fraud schemes (e.g." Get rich soon " or “work at home” scams that are only identified for the purpose of duplicating users)

• Unacceptable, Incorrect Category (e.g. office beds categorized under furniture table).

• Populations of endangered animals or animals advertised for battle or offensive purposes

• Loans, funding programs & business financing

2. VALUE ADDED SERVICES (“VAS”) AND ONLINE PURCHASES(“OP”)

TSAOM offers a range of value-added services where users can pay a non-refundable fee to have their listings listed at particular locations on the Website, thus potentially raising listing visibility. You may be required to transfer such information, which may be controlled by its own terms of use and other policies, through a third party service provider, the Third Party Portal, in order to buy a paid listing service. TSAOM provides no reference or guarantee as to the confidentiality or security of the information transmitted to any third-party platform, and your exposure to any third-party platform is at your own risk and TSAOM assumes no responsibility whatsoever in connection with it.

3. TSAOM Wallet

TSAOM Wallet is a credit system that allows enrolled users to buy credits or points that can be used for the purchase of products or services provided by TSAOM. TSAOM Wallet credit or points cannot be redeemed for cash and does not receive interest or rewards and cannot be refunded. If not used, the purchased credit or points will automatically expire after one year of the purchase date and you consent and agree to this and:

1. Only signed up users are allowed to buy credits and use the service of TSAOM wallet.

2. All transactions of TSAOM Wallet credits are final and unchangeable, and non-refundable.

3. TSAOM reserves the right to stop selling and/or adjust the cost of TSAOM Wallet credits, as well as the manner in which a registered consumer can, at the user absolute discretion, buy, store and/or use TSAOM Wallet credits.

4. A registered user may use TSAOM Wallet credits to buy any of the VAS products and services from TSAOM or any other services that may be made available in the future.

5. TSAOM Wallet credits cannot be used by registered users to buy goods and services not provided by TSAOM or to purchase products or services posted on TSAOM by other users.

6. TSAOM Wallet credits cannot be passed to another account on TSAOM by a registered user.

7. One year after its purchase, each TSAOM Wallet credit acquired by a registered user expires. Once the user account is inactive, deactivated or otherwise terminated, all TSAOM Wallet credits, if any, will be forfeited automatically. TSAOM reserves the right, without notice, to forfeit any TSAOM Wallet credit which it claims has been obtained or gained directly or indirectly by deceitful or unlawful means and is not held liable in any way whatsoever.

8. If TSAOM is certain or has proof that any of these rules or other Terms of Use or Privacy Policy has been breached by a user, TSAOM may: (a) prohibit the use of TSAOM Wallet credits by the user; and/or (b) delete and/or change the listing, Paid Ads and/or posts without prior notice.

You accept, by using TSAOM wallet, that:

TSAOM can, at any time and without advanced notice, modify, change and/or terminate I any of its products or services, including TSAOM Wallet, in whole or in sections, and (ii) these terms and conditions. Any updating, alteration and/or termination shall occur immediately upon uploading or deployment on any Website or Service. TSAOM reserves the moral right, in its sole discretion, to control, delete, manage, change and/or regulate TSAOM Wallet, its material, network, technology, platform and all related matters, and TSAOM has no responsibility whatsoever in the exercise of those rights. In order to investigate system errors or to confirm any recorded or possible breach of these terms and conditions or any of TSAOM policies, rules and regulations, TSAOM can audit and inspect the TSAOM Wallet account of a user. Any TSAOM wallet dispute should be reported to TSAOM within twenty-four (24) hours from the time the user discovers the issue. The consumer waives all charges against TSAOM irrevocably and absolutely.

4. CONDUCT

You agree not to publicly or privately post, email, host, display, upload, modify, publish, transmit, update or share any information on the Platform, or otherwise make available Content:  

• that violates any law or regulation;

• that is copyrighted or patented, protected by trade secret or trademark, or otherwise subject to third party other intellectual property or proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission or a license from their rightful owner to post the material and to grant TSAOM all of the license rights granted herein;

• that infringes any of the foregoing intellectual property rights of any party, or is Content that you do not have a right to make available under any law, regulation, contractual or fiduciary relationship(s);

• that is harmful, abusive, unlawful, threatening, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy or other rights, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or illegal gambling or harms or could harm minors in any way or otherwise unlawful in any manner whatsoever;

• that harasses, degrades, intimidates or is hateful towards any individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;

• that violates any (local) equal employment laws, including but not limited to those prohibiting the stating, in any advertisement for employment, a preference or requirement based on race, color, religion, sex, national origin, age, or disability of the applicant;

• that includes personal or identifying information about another person without that person's explicit consent;

• that impersonates any person or entity, including, but not limited to, an TSAOM employee, or falsely states or otherwise misrepresents an affiliation with a person or entity;

• deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

• that is false, deceptive, misleading, deceitful, or constitutes "bait and switch" offer;

• that constitutes or contains "network marketing", "multi-level marketing", "Ponzi and pyramid schemes," "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," or unsolicited advertisements of a commercial nature;

• that constitutes or contains any form of advertising or solicitation if (1) posted in areas or categories of the Platform which are not designated for such purposes; or (2) e-mailed to TSAOM users who have requested not to be contacted about other services, products or commercial interests;

• that includes links to commercial services or Third-Party Platforms, except as specifically allowed by TSAOM;

• that advertises any illegal services or the sale of any items the sale of which is prohibited or restricted by applicable law, including without limitation items the sale of which is prohibited or regulated by applicable law of local jurisdiction;

• that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or any other computer resource;

• that disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the Service, or that otherwise negatively affects other users' ability to use the Service; or

• that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Service.

Also, you agree not to:

• contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose, specifically, contact any user to post advertisement on a third-party Platform or post any advertisement on behalf of such user; or to "stalk" or otherwise harass anyone;

• make any libelous or defamatory comments or postings to or against anyone;

• collect personal data about other users or entities for commercial or unlawful purposes;

• use automated means, including spiders, robots, crawlers, data mining tools, or the like to download or scrape data from the Service, except for internet search engines (e.g,. Google) and non-commercial public archives (e.g. archive.org) that comply with our robots.txt file;

• post Content that is outside the local area or not relevant to the local area, repeatedly post the same or similar Content, or otherwise impose unreasonable or disproportionately large loads on our servers and other infrastructure;

• post the same item or service in multiple classified categories or forums, or in multiple areas or/and cities; or/and neighborhoods;

• attempt to gain unauthorized access to computer systems owned or controlled by TSAOM or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the Platform;

• use any form of automated device or computer program (sometimes referred to as "flagging tools") that enables the use of TSAOM’s "flagging system" or other community control systems without each flag being manually entered by a human that initiates the flag (an "automated flagging device"), or use any such flagging tool to remove posts of competitors, other third parties or to remove posts without a reasonable good faith belief that the post being flagged violates these Terms or any applicable law or regulation;

• use any automated device or software that enables the submission of automatic postings on TSAOM without human intervention or authorship (an "automated posting device"), including without limitation, the use of any such automated posting device in connection with bulk postings, or for automatic submission of postings at certain times or intervals; or

• any Content uploaded by you shall be subject to relevant laws and may be disabled or deleted, and/or may be subject to investigation under appropriate laws. Furthermore, if you are found to be in non-compliance with the laws and regulations, these Terms, or the Privacy Policy of the Platform, TSAOM may terminate your account/block your access to the Platforms or Services and TSAOM reserves the right to remove any non-compliant Content uploaded by you without any prior notice, and shall not be held liable in any way whatsoever.

5. PAID POSTINGS

In some areas of the service, TSAOM can take a fee for uploading content. The fee allows for the uploading of such material in a specified category of the website. It is the responsibility of any party uploading content to the Website or / and Service for said content and compliance with the Terms. In the event of any Material being withdrawn from the Site for breaching these Terms, any such fees charged hereunder shall be non-refundable.

6. NOTIFICATION OF CLAIMS OF INFRINGEMENTS

TSAOM shall not be liable for any breach by end users or any other third party of copyright and/or other intellectual property rights resulting from materials posted on or distributed through the Platform, or products advertised on the Platform. If you are an intellectual property rights owner or an agent who is fully licensed to operate of the intellectual property rights owner and claims that any material or other content infringes your intellectual property right or the intellectual property right of the owner on whose behalf you are authorized to act, you may send a notice to TSAOM along with a request for action. Cooperation between TSAOM and TSAOM shall not be regarded in any way as an admission of its responsibility and/or liability in whole or in part for any such infringement The notification and the request shall include the following information:

1. Physical or electronic signature of a person allowed to act on behalf of the proprietor of an allegedly violated exclusive right;

2. Recognition of intellectual property rights reported to have been violated or, if a single notice includes multiple intellectual property rights on a single web domain, a representative list of such works on that site;

3. Recognition of the Content believed to be unlawful or to be the subject of unlawful activity (by means of data or communication connection, Post ID, listing ID, etc.) that is to be deleted or reached which is to be disabled and details reasonably sufficient to enable TSAOM to locate the material;

4. Reasonably accurate data to allow TSAOM to contact you, such as an address, telephone number and, where appropriate, e-mail address;

5. A written declaration that you have a good faith belief that the intellectual property right-owner, its representative, or the law does not allow the use of the content in the manner complained of;

6. The written declaration that the intellectual property owner keeps TSAOM harmless from any claim by any third party in connection with the removal of the related material by TSAOM; and

7. Written declaration that the information in the notification is correct and that you are allowed to act on behalf of the owner of the exclusive right allegedly infringed under penalty of deceit.

8. NO SPAM POLICY

This report has major legal implications for you. You take on risk, obligations and responsibility in this section. This could result in you being disciplined under existing criminal laws and/or you being financially responsible for additional sums to TSAOM and/or other individuals. You accept and agree that these Terms specifically forbid sending unsolicited email ads or other unsolicited communications to TSAOM users or email addresses or through TSAOM computer systems. You accept and agree that TSAOM can track use from time to time using human monitors or automated software to flag such spam or scam-related words sent between one user and another on the systems, services and platforms of TSAOM, whether public or private. Any communication between yourself and any other user using the Service and Platform communication features can only be used in compliance with the Terms. Any unauthorized use of TSAOM computer systems is in breach of the provisions of these Terms and of certain applicable laws, in particular and without limitation of any applicable law on cybercrime. These violations can impose civil and criminal penalties on the sender and his or her agents. Please notice that the law on cybercrimes carries essential penalties, including incarceration. In the event that you plan to request or contact our users by obtaining from our Platform any of their records, email or telephone numbers, we may report this conduct to the competent authorities, who may then decide to prosecute you under the laws of the relevant country.

9. LIMITATION AND TERMINATION OF SERVICE

This report has substantial legal implications for you. In this section:-TSAOM 's legal and liability obligations are restricted or excluded;-the rights or recourse that you may have against TSAOM are limited or excluded; and-danger, liability and liability are assumed. TSAOM may set limits from time to time for the use of the Service, including, but not limited to, the maximum number of days in which the Content will be maintained or stored by the Service, the maximum number and size of posts, e-mails, chat messages, or other Content that may be publicly or privately transmitted or stored by the Service, and the frequency with which the Service may access the Content. TSAOM shall not be responsible or liable for the deletion or inability to store any Content maintained or distributed by the Website or the Service, as far as the law permits. TSAOM reserves the right at any time, with or without warning, to change or discontinue the Service (or any part thereof), and that TSAOM is not responsible for any such modification, suspension or discontinuance of the Service to you or to any third party. You accept and agree that TSAOM has the right (but not the obligation) in its sole and absolute discretion to delete or disable your account, block your e-mail or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without prior warning, disable or discontinue any VAS or OP, and remove or discard any Material within the Service. Furthermore, as far as the law allows, you accept that TSAOM is not responsible for any termination of your connection to the Website or to the Services by you or any third party.

10. ABILITY TO ACCEPT TERMS OF SERVICE

This site is intended for adults only and you are qualified for contracts in compliance with relevant laws. You accept that you are legally allowed to represent that person / entity when you use / access this Platform as a representative of any individual / entity. Youth shall only be authorized to access the Website and to use the Service if their legal representatives have approved it or if it involves an act or transaction which is a common and appropriate standard of civil life and practice. You reflect that you are either at least 18 years of age, or an emancipated minor, or have parental or guardian legal consent, and are completely capable and qualified to enter into, and to comply with, the terms, conditions, duties, affirmations, agreements, representations, and warranties set out in these Terms. You can only do so through your parent or legal guardian if you are a minor and want to contact us.

11. ASSIGNMENT

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by TSAOM without restriction. Any assignment or transfer by you shall be worthless and canceled.

12. DISCLAIMER OF WARRANTIES

In this Section: - the legal responsibilities and liability of TSAOM are limited or excluded; - the rights or remedies you may have against TSAOM are limited or excluded; and - you take on risk, responsibilities and liability. There are things that may go wrong when using the Platform and/or the Service, including what is listed in this Section. TSAOM is not responsible or liable for anything that goes wrong, including without limitation to what is listed in this Section. You use the Platform and the Service knowing and accepting that these things can go wrong and that there are risks. TSAOM MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE PLATFORM'S CONTENT OR THE CONTENT OF ANY THIRD PARTY PLATFORMS LINKED TO THE PLATFORM AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II)PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE PLATFORM AND SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE PLATFORM, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE PLATFORM BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, COMMUNICATED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE PLATFORM OR THE SERVICE. TSAOM DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE PLATFORM OR ANY HYPERLINKED PLATFORM OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND TSAOM WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND/OR OTHER USERS AND/OR THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS FAR AS THE LAW ALLOWS, IN NO EVENT SHALL TSAOM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF TSAOM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF THE PLATFORM OR THE SERVICE, INCLUDING WITHOUT LIMITATION WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE PLATFORM OR THE SERVICE, FROM INABILITY TO USE THE PLATFORM OR THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE PLATFORM OR THE SERVICE, (iv) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (v) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO AND USE OF THE PLATFORM AND SERVICE, (vi) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (vii) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE PLATFORM, (viii) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE PLATFORM BY ANY THIRD PARTY, (ix) ANY ERRORS OR OMISSIONS IN ANY CONTENT, (x) ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, COMMUNICATED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE PLATFORM OR THE SERVICE. SUCH LIMITATION OF LIABILITY SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE PLATFORM OR THE SERVICE OR ANY LINKS ON THE PLATFORM, AS WELL AS BY REASON OF ANY INFORMATION, OPINIONS OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE PLATFORM OR THE SERVICE OR ANY LINKS ON THE TSAOM SITE. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. AS FAR AS THE LAW ALLOWS, YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT TSAOM SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY USER OR THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. TSAOM MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE PLATFORM IS APPROPRIATE FOR USE IN OTHER LOCATIONS. THOSE WHO ACCESS OR USE THE PLATFORM FROM OTHER JURISDICTIONS DO SO AT THEIR OWN VOLITION AND RISK AND ARE RESPONSIBLE FOR COMPLIANCE WITH THE LAW.

13. LIMITATIONS OF LIABILITY

IN NO EVENT SHALL TSAOM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF TSAOM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF THE PLATFORM OR THE SERVICE, INCLUDING WITHOUT LIMITATION WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE PLATFORM OR THE SERVICE, FROM INABILITY TO USE THE PLATFORM OR THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE PLATFORM OR THE SERVICE. SUCH LIMITATION OF LIABILITY SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE PLATFORM OR THE SERVICE OR ANY LINKS ON THE PLATFORM, AS WELL AS BY REASON OF ANY INFORMATION, OPINIONS OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE PLATFORM OR THE SERVICE OR ANY LINKS ON THE TSAOM SITE. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT TSAOM SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY USER OR THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. YOU WILL INDEMNIFY AND HOLD US HARMLESS FROM ANY CLAIM OR DEMAND, REASONABLE LEGAL FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS TERMS OF USE INCLUDING ANY CLAIM AGAINST US FOR INTELLECTUAL PROPERTY INF, YOUR IMPROPER USE OF OUR PLATFORM OR YOUR BREACH OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.

14. ACCEPTANCE THE TERMS OF USE

By accessing and using the Platforms and Services you agree to be bound by Privacy Policy and the Terms of Use. If you do not agree to abide by the terms of these terms, Terms of Use, Privacy Policy and our other Policies, you are not authorized to access or use the Platforms and Services.

15. MISCELLANEOUS

    1. You accept that your use of or connection to the Platform and the Facilities will be resolved in accordance with the laws of Saudi Arabia without regard to the principles of conflict of laws with regard to any argument or dispute in law or equity that has arisen or may arise between you and TSAOM (or any relevant third party) relating in any way to the Terms.

    2. If any provision of the Terms is held to be invalid, void or for any reason unenforceable, such provision shall be struck out and shall not affect the validity and enforceability of the remaining provisions.

    3. Headings are for reference purposes only and do not limit the scope or extent of such Section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of the Terms.

    4. he Terms and all terms and polices posted through our Services set forth the entire understanding and agreement between you and TSAOM, and supersede all prior understandings and agreements of the parties.

    5. The following Sections survive any termination of the Terms: Conduct; Disclaimer of Warranties; Limitations of Liability and Miscellaneous.
